PROP RENTAL POLICY

 

PERIOD

 

The period of rental starts when the prop(s) leave the possession of propaprops (hereinafter also called "us", “we”, “our”) or a propaprops representative and the signature of the renter or his/her representative shall be conclusive proof of the passing of possession from propaprops to the renter and acceptance of the terms and conditions of the PROP RENTAL POLICY.

The period of rental will continue until possession of the prop(s) passes back to us or a propaprops representative and it is the responsibility of the renter to obtain from us or a propaprops representative written acknowledgement of receipt of the prop(s) which shall alone constitute evidence of the return of the prop(s) to us.

 

 

PROPS

 

The prop(s) rented shall remain the absolute property of propaprops.

We will only rent to Film, TV or Theatre production be it professional or amateur and are willing to offer support to students from legitimate colleges and universities, dependent on having written authorization from a senior member of staff.

We will not accept any liability for any damage, personal injury or trouble with the authorities for improper or dangerous use, care, storage and transportation of the prop(s). You must be over 18, have insurance covering the rental of the prop(s). And the renter of the prop(s) must notify their insurers and local authorities that replica firearms will be used in their production.

The renter must be linked or associated with the Film, TV or Theatre production and hold a senior position. E.g. (Director, Director of Photography, Producer, Prop Manager etc.).

The person(s) collecting the prop(s) should provide two forms of identification, one photographic (driving license, passport etc.) and proof of address (a utility bill or invoice of the company). They must accept that they will be responsible for the safekeeping and the correct and proper use of the prop(s) and that the crew involved are suitably trained

 

to use the prop(s) without doing harm to themselves, others or causing damage to the prop(s).

Replica firearms should never be allowed to be displayed in public or taken from safe storage for any other purpose than rehearsals or performances. Only the renter and person(s) directly involved with scenes using the prop(s) should be the only ones allowed to handle the prop(s) and at all other times the prop(s) must be stored and locked away.

The renter must take full responsibility to meet all the existing legal requirements of the Violent Crime Reduction (VCR) Act before renting any replica prop weapon(s).

 

It is highly recommended that the renter informs the local authorities for professional advice if the props are going to be used in an area that is not private property, a studio or a theatre or anywhere there is the very likely possibility that the prop(s) could be seen by the general public.

It is the responsibility of the renter to satisfy himself/herself that upon receipt of the prop(s) they are in good working order and undamaged condition. and the signature shall be conclusive evidence that the renter has received the prop(s) in good working order and undamaged condition. We will not be responsible for any defects or deficiencies in the equipment unless an appropriate specific note has been made and such note has been Signed by the us or a propaprops representative.

We do not warrant that the prop(s) will be suitable for the particular or any purpose for which it is or may be required.

The renter shall not assign transfer or otherwise part with possession of the prop(s) during the period of rental without the prior written consent of propaprops or a propaprops representative.

The renter shall not take or permit to be taken the prop(s) out of the United Kingdom nor use or permit it to be used for any abnormal or hazardous assignments without the prior written consent of propaprops or a propaprops representative.

Prop Weapons cannot be posted under any and all circumstances and must be collected and returned in person by the renter who will be legally responsible for the safety and security of the prop(s), cast, crew and the public.

 

 

LOSS OF OR DAMAGE TO THE PROP(S)

 

During the period of rent the renter shall be responsible for the safe keeping of the prop(s) and shall be liable to us for all loss of or damage to the prop(s) howsoever caused.

The renter shall notify us of any loss of or damage to any props(s) on rental within 48 hours of such loss or damage being sustained.

The renter shall not carry out or attempt to carry out any repairs to any damaged prop(s) without the prior written authority of propaprops.

The renter shall pay to us all costs incurred for carrying out repairs to any damaged prop(s).

The renter shall pay to us the full cost of replacing any lost prop(s) or any prop(s) which in the reasonable opinion of propaprops is uneconomic to repair with any new prop(s) of the same or similar specification to that equipment which has been lost or damaged.

During any period in respect of which the renter has not already paid to us the cost of renting any prop(s) which shall be lost or damaged as mentioned above and until such time as payment shall be made to propaprops pursuant to conditions above, the renter shall pay to us compensation for the loss of use of the prop(s) lost or damaged at a rate equivalent to charges currently made by propaprops for the rental of such equipment.

 

 

INSURANCE

 

Unless prior to the start of the period of rental propaprops has received from the renters insurers a declaration in a form acceptable to us that the renter has arranged insurance to the satisfaction of propaprops or if at any time propaprops receives notification of the lapsing or variation of the renters said insurance or fails to receive prompt and sufficient confirmation that such insurance remains in effect then we shall be entitled (but not obliged) to arrange insurance of the prop(s) for the full replacement value against all damage or loss consequential or otherwise including without prejudice to any payment of monies to propaprops pursuant to the conditions above and also for Public Liability against claims made by third parties arising from use or miss-use of any prop(s).

 

In respect of any order cancelled by the renter within 24 hours of the date when the period of rental was to start the renter shall be liable to pay to us a cancellation charge not exceeding the total agreed rental charge for the cancelled rental.

 

 

LIMITATION OF LIABILITY

 

If propaprops for any reason is unable to provide any prop(s) which is the subject of an agreement between propaprops and the renter, then propaprops shall not be liable for any loss or consequential loss suffered by the renter as a result thereof.

 

 

PAYMENT

 

We use Paypal for online payments. Paypal allows us to safely process your payments and complete the financial transactions as securely as possible. For further information regarding PayPal’s secure systems please visit their website https://www.paypal.com/uk

A security deposit by credit/debit card or cash is required from all customers. The amount of deposit depends upon the prop(s) being rented.

Unless otherwise expressly provided all rental charges are to be paid in full together with the deposit as determined by us before the rental period is in effect.

Additional rental charges for the period overdue will be made for equipment returned after 10 am on the due date.

Method of payment as detailed at the time of rental unless otherwise arranged.

The Renter undertakes to pay the account in full on or before the due date. In default of such payment the Renter undertakes to pay interest on any outstanding amount at the rate of 2% per week and to indemnify us and pay collection costs plus all costs and expenses on a solicitor/client basis which we may incur recovering from the Renter any overdue amount.

If by error, we have under-priced a prop item, we will not be liable to supply the prop to you at the stated price, provided that we notify you before we rent the prop to you. In those circumstances, we will notify the correct rental prices to you so you can decide if you wish to rent the prop at that price.

 

 

INDEMNITY

 

The renter shall at all times fully indemnify propaprops its owner, employees, servants and agents against all actions costs claims demands proceedings or liabilities arising from or in connection with any prop(s), materials or any other services supplied to the renter by propaprops.

EQUIPMENT RENTAL POLICY

 

 

PERIOD

 

The rental period is from the time the equipment leaves us until it is returned to us.

Rental starts at 12 noon on the first day specified and ends 10 am on the last day specified

No allowance whatsoever can be made for time when equipment is not in use for any reason.

 

 

EQUIPMENT

 

The equipment is agreed to be as stated on the Rental Policy Agreement form or letter.

The Owner does not represent or warrant the equipment supplied or its capacity or its performance is fit for the purpose for which the renter requires.

While every endeavour is made to supply equipment as ordered, we reserve the right to substitute other designs where necessary.

We will not be responsible for any delays, accidents or loss or damage of any kind direct, indirect or consequential which may arise through defects or breakdowns of the equipment hired.

 

 

NON SUPPLY

 

We will endeavour to supply equipment as ordered but cannot accept responsibility for no equipment availability, or inability to supply when required.

 

 

LOSS OR DAMAGE

 

The Renter accepts full responsibility for loss or damage howsoever caused from the time the equipment is rented from us until the equipment is returned to us.

Please note that insurance of equipment during the rental period is the responsibility of the Renter.

 

 

PROPER USE

 

The Renter shall only use the equipment for the purpose and within the capacity limits for which it has been designed and will not attempt to alter, repair or modify the equipment.

 

 

DAMAGE TO EQUIPMENT

 

If any equipment is damaged or destroyed it must nevertheless be returned to us.

 

 

FAULTY EQUIPMENT

 

If the Renter considers any equipment to be faulty as supplied, he must notify us immediately and rental will cease from the time such notification is received if the equipment is found to be faulty by us.

 

 

RETURN OF GOODS

 

Replacement cost of any equipment or part thereof not returned on the due date will be charged to the Renters.

 

 

PACKING - CONTAINERS ETC.

 

All equipment is suitably packed where necessary. Such packing must be used by the Renter when returning the equipment, otherwise cost of such packing will be charged to the Renter

 

 

PAYMENT

 

The charges for the hire are stated on the Rental Policy Agreement form.

Unless otherwise expressly provided all rental charges are to be paid in full together with the deposit as determined by us before the rental period is in effect.

Additional rental charges at the rate quoted on the Rental Policy Agreement form for the period overdue will be made for equipment returned after 10 am on the due date.

Method of payment as detailed at the time of rental unless otherwise arranged.

TERMINATION

 

If default exceeding seven days is made on any payment due on account of the rental, or if there is any other breach of the Equipment Rental Policy then we reserve the right to terminate the rental period forthwith, and to take any steps necessary to recover possession of the equipment without prejudice

to our rights to recover all amounts due for rental, reconditioning, and cost for transport us.

 

 

PROPERTY RIGHTS

 

All equipment remains the absolute property of propaprops. The Renter undertakes to keep the equipment in his own possession and control, and free from any liens, charges, encumbrances and any other interest whatsoever.

 

 

INSPECTIONS

 

We reserve the right to inspect the equipment at any time.

 

 

OUR LIABILITIES

 

We undertake no liability whatsoever in respect of third party and similar risks or for personal injury or for consequential damage of any kind.

 

 

CONDITION OF GOODS ON RETURN

 

On termination of the rental, the Renter shall deliver up the equipment, complete with all accessories, clean and in order as supplied, to us.

 

 

ACCEPTANCE

 

Notwithstanding that the Renter may not have signed the Rental Policy, and the acceptance by the Renter of any goods rented from us shall in itself constitute an acceptance of the above Rental Policy, and of the charges stated on the Rental Policy Agreement form or acknowledgment of order.
